In the field of construction litigation, our attorneys have represented general contractors and subcontractors seeking claims recovery due to issues such as differing site conditions, removal from pre-qualified bidder lists, delay claims, acceleration issues, payment and performance bond claims, and liens and warranty claims. The firm has also handled exculpatory clause issues, considered the enforceability of arbitration clauses, and managed contract changes and implied contractual obligations. Recently, our attorneys represented owners in claims against design professionals and general and specialty contractors in recovering damages for a retaining wall failure, defective plans and specifications, defects in performance, and warranty claims, and also represented engineering professionals in asserting and defending claims of breach of contract, fraud, and promissory estoppel.
